HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No.1052 OF 2018 JUDGMENT (ORAL) : (Per The Hon'ble The Chief Justice Sri Thottathil B. Radhakrishnan) This Writ Appeal with leave is filed by two persons, one of whom is stated to be an Advocate. Hearing the learned counsel, we see that the concern expressed is about the directions issued through the order dated 16.07.2018 in W.P. No.22721 of 2018. Having bestowed our anxious attention to the contents of that order, we see that all that the learned single Judge has done is to direct respondent No.3 i.e., Station House Officer, Pendurthi Police Station, Visakhapatnam, Visakhapatnam District, to follow the guidelines in Lalita Kumari v. Government of Uttar Pradesh1 in relation to a case stated to have been filed before that officer by respondent No.1 - writ petitioner viz., Silaparasetty Kanakamahalakshmi.

We are clear in our mind that even if the appellants state that the complaint was closed, referred or that it has become outdated by efflux of time, those are matters which will fall within the scope of scrutiny of the Police Officer concerned in terms of Lalita Kumari (Supra 1). In such circumstances, we do not find any ground to entertain this matter. Hence, the writ appeal fails.

HCJ & SVB,J WA No.1052 of 2018 Therefore, the Writ Appeal is dismissed. There shall be no order as to costs.

As a sequel thereto, Miscellaneous Applications, if any, pending in the Writ Appeal stand closed.
