Villuri Srinivasa Rao, v. State Of Andhra Pradesh
IN THE HIGH COURT OF JUDICATURE AT HYDERABAD
FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) WEDNESDAY, THE THIRD DAY OF MAY TWO THOUSAND AND FIFTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.15432 of 2015 BETWEEN V.Srinivasa Rao ... PETITIONER AND State of Andhra Pradesh, rep. by its Principal Secretary and others ...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. Petitioner states that a sale deed was executed in his favour on 06.11.2014. The same was presented for registration and it was registered, but the document is not released by keeping it as pending document No.P 327 of 2014. Petitioner states that respondent No.2 issued notice raising objection for registration vide notice, dated 10.12.2014. Petitioner has already submitted explanation thereto dated 17.12.2014. The grievance of the petitioner is that respondent No.2 is not taking any decision in the matter and not passing appropriate order after looking into the explanation submitted.
3. Since the explanation was already submitted by the petitioner on 17.12.2014, I do not see any reason for respondent No.2 not to consider the same and pass appropriate orders with regard to registration of the said pending document. Writ petition is, therefore, disposed of directing respondent No.2 to consider the explanation submitted by the petitioner to respondent No.2's notice dated 10.12.2014, referred to above, and take appropriate decision by passing necessary orders with regard to registration of the document executed in faovur of the petitioner, as above, within two weeks from the date of receipt of a copy of the order. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. _____________________ VILAS V. AFZULPURKAR, J June 3, 2015 Lmv
