THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.42904 OF 2015 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

Though the report, dated 05.07.2014, given by the Tahsildar, Guntur Mandal, Guntur District, the 2nd respondent, shows that the land in question is not an Endowments land, the Sub-Registrar cannot act merely on the basis of the letter of the 2nd respondent and unless a competent authority takes an appropriate decision, the request of the petitioners for taking up registration of their land cannot be considered.

The report itself shows that the subject land is already included in the prohibited list sent by the Endowments Department under Section 22-A of the Registration Act. Hence, unless the said land is deleted from the prohibited list, no relief can be granted to the petitioners. However, the petitioners are at liberty to make appropriate application for deletion of the subject land by approaching the competent authority.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
