THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13036 of 2024 ORDER:

This Criminal Petition is filed under section 482 of bharatiya Nagarik Suraksha Sanhita, 2023 for grant of prearrest bail to the petitioners who are arrayed as accused Nos.3 and 6 in Crime No.100 of 2024 of Nagarkurnool Police Station, Nagarkurnool District.

The brief facts of the case are that accused No.1 and his family members are managing and running the affairs of 'Om Sri Sai Ram Finance', Nagarkurnool, without any registration or authorization from the Government and collecting amounts from the general public and promising to give 2% interest on the amounts and cheated the general public by not returning their amounts.

Heard Sri K. Ramakrishna, learned counsel appearing on behalf of the petitioners as well as Sri Syed Yasar Manoon, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioners submitted that though the petitioners are no way concerned with the alleged offences, merely being the family members of accused No.1, they were falsely implicated in the case. He further submitted that there are no specific allegations against the petitioners, and hence, prayed the Court to grant anticipatory bail to the petitioners by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor has opposed the grant of anticipatory bail stating that the specific allegations are leveled against the petitioners and prayed the Court to dismiss the criminal petition. 6.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it is apparent that the petitioners are the family members of accused No.1 and there are no specific allegations leveled against them. In the said circumstances, this Court is inclined to grant anticipatory bail to the petitioners subject to the following conditions:

i.

The petitioners shall surrender before the Station House Officer of P.S. Tadoor within two weeks from today, and on such surrender, the

said Station House Officer shall release the petitioners on bail on executing personal bond for Rs.20,000/- with two sureties each for the like sum.

ii.

The petitioners shall abide by the other conditions stipulated in Section (2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
