O R D E R

Apprehending that respondents 2 to 4 - revenue authorities may amend the revenue entries in respect of subject land in the writ petition at the instance of 5th respondent without following the procedure contemplated under Section 5(3) of the A.P Rights in Land Pattadar Pass Books Act, 1971 and the Rules made there under, the present writ petition has been filed. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

It is nowhere stated in the writ affidavit that the 5th respondent has filed any such application seeking amendment of the revenue entries. Mere apprehension cannot form basis to file writ petition and no order can be passed in anticipation. I do not see any reason to entertain the writ petition. Since it is stated that the name of the petitioner is found in the revenue records, if any application is filed seeking amendment of the revenue entries in respect of the subject land in the writ petition, the same shall be disposed of by the competent authority in accordance with law after due notice to the petitioner, if the petitioner's name is recorded in revenue records in respect of the subject land.

With the above observation, the writ petition is dismissed. No costs. Miscellaneous petitions pending if any, shall stand closed. AVS ----------------------------------- 13-10-2016
