This petition is filed under Section 438 Cr.P.C. seeking bail to petitioner/A.1 in the event of his arrest in connection with Crime No.215 of 2021 of Humayunnagar Police Station, Hyderabad, registered for the offences punishable under Sections 307, 341 and 506 read with 34 of the Indian Penal Code.

Heard Mr.K.Venumadhav, learned counsel for the petitioner, and learned Assistant Public Prosecutor for the respondent-State. 3.

Learned counsel for the petitioner submits that in the complaint it is stated that there are disputes between the petitioner and his wife, who is de facto complainant's daughter, and their marriage was performed about twenty years back and divorce proceedings are pending between them and earlier the petitioner attacked the de facto complainant's elder son and a complaint was registered. He further submits that as far as this case is concerned, where the de facto complainant's younger son has sustained injuries. There are no allegations in the complaint that petitioner was present at the scene of offence on that day and there are no specific overt acts against the petitioner. Hence, his case may be considered for grant of pre-arrest bail.

On the other hand, learned Assistant Public Prosecutor submits that son of the de facto complainant sustained serious injuries and the contention that the other accused have stated that the petitioner has hired them and all are arrested and remanded. He submits that in view of the grave allegations and injuries

sustained by the son of the de facto complainant, the petitioner is not entitled for pre-arrest bail.

Taking into consideration the allegations in the complaint, previous disputes pending between the parties and injuries sustained by the son of the de facto complainant, this Court is not inclined to grant pre-arrest bail to the petitioner/A.1.
