O R D E R

Vide the present petition, petitioner seeks direction thereby to relax the bail conditions dated 25.11.2016 passed by the Judicial First Class Magistrate, Railway Kodur, Kadapa District in FIR No.171/ 2016 on the file of Station House Officer, Railway Kodur Police Station, Kadap District, whereby the aforesaid court while releasing the accused on bail, directed to execute personal bond for a sum of Rs.30,000/ - with single local surety along with cash surety for the like sum.

The learned counsel for the petitioner submits that the trial court has noted that the accused is a resident of Maharashtra. Therefore, the petitioner is unable to furnish a local surety and since he is a tribal and poor, is unable to furnish cash surety of Rs.30,000/ -. Keeping in view the averments made in the petition and the submissions of the learned counsel, I hereby modify the above order dated 25.11.2016 and direct that the petitioner/ accused shall be released on bail on furnishing personal bond for a sum of Rs.10,000/ - (Rupees ten thousand only) with one surety of his native place for the like sum to the satisfaction of Judicial First class Magistrate, Railway Kodur, Kadapa District. The petition is accordingly allowed.
