HON'BLE SRI JUSTICE S.V. BHATT W.P.No.32929 OF 2014 ORDER:
The petitioners were assigned house sites patta by respondent No.3. According to petitioners, the assignments are subsisting as on date. The respondents, without recourse to law, are trying to interfere with the possession and enjoyment of petitioners. Hence, the writ petition.
On 18.11.2014, the following interim order was passed: "The Tahsildar-cum-Mandal Revenue Officer, Mandasa, Srikakulam District, is directed to put the writ petitioners on notice, consider their objections and then pass an order for removal of any constructions made on any assigned land and if there is any other land which is occupied by the petitioners, appropriate proceedings under the Land Encroachment Act, 1905, be initiated and let this exercise be accomplished in quick time, so that, the bridge constructed by Roads & Buildings Department between Pottangi and Siripuram Village can be opened up for public use serving the residents of both the villages. Post after two weeks.
Till the Tahsildar passes an order, Tahsildar shall not demolish the houses of the petitioners".
The respondents refer to issuing of notice dated 14.01.2015. The notice already issued can be brought to its logical end. Hence, the writ petition is disposed of by directing respondents not to interfere with the petitioners' possession or enjoyment, except in accordance with law. There shall be no order as to costs.
Consequently, pending miscellaneous petitions, if any, stand closed.
