HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 1616 of 2008 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the impugned charge memo dated 01.05.2007 issued by the respondent, as illegal and arbitrary and consequently declare that the petitioner is entitled for notional promotion as A.E. on regular basis from the date of his juniors' promotion.

When the matter is taken up for hearing, both the counsel have fairly conceded that the issue raised in the writ petition is squarely covered by the judgment of a Division Bench of this Court in W.A.No.664 of 2018 dated 26.04.2018 and in view of the said judgment, the petitioner is entitled for notional promotion. Following the afore-stated judgment, the writ petition is disposed of directing the respondent to grant notional promotion to the petitioner on par with his juniors, but the petitioner is not entitled to any monetary benefits pursuant thereto.

Consequently, miscellaneous petitions pending in the writ petition, if any, shall stand closed.
