THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO AND THE HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No. 564 OF 2015 O R D E R : (per Hon'ble Sri Justice Nooty Ramamohana Rao) This Civil Revision Petition itself can be disposed of as the controversy lies in a very narrow compass and the respondent husband is also represented by a learned counsel before us. The 1st petitioner herein was the former wife of the respondent, whereas petitioners 2 and 3 are their daughters. The petitioners herein moved I.A.No. 531 of 2014 in O.P. No. 1035 of 2010 on the file of the Family Court at Hyderabad seeking a direction to State Bank of Hyderabad, City Civil Courts Branch, Hyderabad to deposit the interest accrued on Fixed Deposit Receipts bearing No. 62352556602 and 62352557968.

It is stated that the 1st petitioner herein and the respondent have worked out a mutual settlement by virtue of which the respondent has agreed to pay a sum of Rs.15 lacs each in the name of his two daughters, petitioners 2 and 3 herein, and he has deposited Rs. 15 lacs through demand drafts drawn on State Bank of Hyderabad, City Civil Courts Branch, Hyderabad. The respondent has also deposited the balance amount of Rs.15 lacs by way of Fixed Deposit Receipts on 04.08.2014 bearing No. 62352556602 and 62352557968. Now the 1st petitioner sought for payment of interest thereon. Learned counsel for the petitioners Sri S.R. Sanku would assure this Court that the interest so accrued on the Fixed Deposit Receipts, if this Court permits to be withdrawn by the 1st petitioner herein, will be spent only for furthering the education of the two

children. Since pursuing education and providing the necessary facilities in that regard is of paramount consideration for us, as that would go a long way for the welfare of the two children, we permit State Bank of Hyderabad to credit the interest accrued on the fixed deposit receipts bearing No. 62352556602 and 62352557968 once in every quarter to the bank account of the 1st petitioner herein. The deposit of quarterly interest must commence from the quarter beginning on 01.04.2016 onwards.

With this, the Civil Revision Petition stands disposed of, modifying the order passed by the Family Court to the extent indicated supra. No costs.

Consequently, the miscellaneous applications, if any shall also stand disposed of.
