THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.25235 of 2017 DATED : 31.07.2017 Between :
Veernala Venkayamma, W/o.Chennaiah, Age 54 yrs, R/o.Kattempudi Village, Ponnur Mandal, Guntur District.
..
Petitioner And State of Andhra Pradesh, Rep., by the District Collector, Guntur, Guntur District & others.
.. Respondents This court made the following :
- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.25235 of 2017 ORDER :
Heard.
2.
The grievance of the petitioner is that even though pattedar pass books and title deeds were issued to the petitioner in respect of land to an extent of Ac.1-70 cents in Sy.No.312-2 of Kattempudi village, Ponnur Mandal, Guntur District, on a complaint made by Smt.Vishnumolakala Putlamma (4th respondent), matter was referred by the District Collector, to the Tahsildar and in response the Tahsildar vide his report dated 25.02.2016 informed the District Collector that O.S.No.52 of 2013 is pending on the file of Senior Civil Judge, Bapatla, and that the survey number is included in the Dispute Register. Petitioner is aggrieved by the said endorsement and challenges the same in this writ petition. 3.
According to learned counsel for the petitioner, suit instituted by the 4th respondent and two others was dismissed for non-prosecution by order dated 24.07.2014.
4.
From a reading of the report of the Tahsildar, it appears that Tahsildar was not appraised of the dismissal of suit in the year 2014 itself. Learned counsel for the petitioner states that the suit is not restored and the order of dismissal stands. 5.
However, the affidavit is silent as to the efforts made by the petitioner to appraise the Tahsildar or District Collector about the dismissal of suit.
- 3 - 6.
At this stage, learned counsel for the petitioner seeks leave of the Court to appraise the fact of dismissal of O.S.No.52 of 2013 to the Tahsildar and the District Collector respectively. 7.
Having regard to the said submission, without expressing any opinion on merits, the writ petition is disposed of, granting liberty to the petitioner to appraise the dismissal of O.S.No.52 of 2013 to the Tahsildar as well as District Collector. If such a representation is made, the Tahsildar shall examine the same and take immediate steps with reference to inclusion of property in the Dispute Register and also submit report consequently to the District Collector. Such exercise shall be taken within a period of two (2) months from the date of receipt of such representation. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
