THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.11288 and 11294 of 2023 COMMON ORDER:

1.

These Criminal Petitions are filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners in Crime No.1258 of 2023 on the file of the Gachibowli Police Station, Madhapur-Cyberabad Division, registered for the offences under Section 20(b)(ii)(c) of Narcotic Drugs Psychotropic Substances Act and Section 34(A) of Telangana State Excise Act.

Since the petitioners in both the petitions are arrayed as accused Nos.1 and 3, in the very same crime, both the petitions are heard together and disposed of by this common order.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioners were arrested on 25.10.2023 for being in possession of 7.5kgs of Ganja and 117 liquor bottles of

various brands. Five family members were arrayed as accused in the said crime. The contraband was found in the house.

This Court by order dated 15.11.2023 in Crl.P.Nos.11200 and 11195 of 2023 has granted regular bail to accused Nos.2 and 4 in the present Crime and these petitioners also stand on the same footing. Hence, the prayer for regular bail is considered, subject to the following conditions:

i) The petitioners/Accused Nos.1 and 3 shall execute a personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) each with two sureties for a like sum each to the satisfaction of the X Additional Metropolitan Magistrate at Kukatpally, Cyberabad. ii) The petitioners/Accused Nos.1 and 3 after release shall appear before the concerned Station House Officer on every Monday between 10.30am and 1.00pm, for a period of four (04) weeks and thereafter, as and when required, for the purpose of investigation.

iii) The petitioners/Accused Nos.1 and 3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, both the Criminal Petitions are allowed. Miscellaneous applications, pending if any, shall stand closed.
