THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3410 of 2015 ORDER:

Upon hearing both sides, at the admission stage, the following Order is passed:

In view of the prima facie accusation contained in the FIR to the effect that the petitioner/accused being the Manager of Kurnool Seeds Private Limited, Kurnool, collected amounts from the distributor and did not account for to the complainant's company, it is not a fit case to quash the proceedings. Therefore, the investigation shall be continued to its logical end. However, considering the submission of the learned counsel for petitioner, the Police of Kowthalam Police Station, Kurnool District, are directed to strictly follow the procedure contemplated under Section 41-A Cr.P.C. towards the petitioner/Accused in Crime No.42 of 2015 during the course of investigation. The petitioner shall cooperate with the investigating agency for smooth completion of investigation.

Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions, if any, pending shall stand closed.
