THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION NO. 16174 of 2005 ORDER :

Heard learned counsel for the petitioners and learned Government Pleader.

The present writ petition came to be filed questioning the order passed by the MRO, which was confirmed by the RDO and the Joint Collector, wherein the petitioners herein have questioned the mutation of the names of the respondents in revenue records. 3.

Today, at the time when the matter is taken up for hearing, it is brought to the notice of the Court that the petitioners filed O.S.No.46 of 2005 at Karimnagar seeking partition of the property and the same is still pending for adjudication.

Having regard to the above, nothing survives for adjudication in the writ petition. Since the civil suit is pending, wherein the rights of the parties are in dispute, the petitioners shall take suitable steps for disposal of the suit, at the earliest. If no interim orders are passed by the civil Court with regard to possession, the petitioners shall make an application seeking interim order, which shall be dealt with at the earliest. In view of the interim order dated 25.07.2005, passed by this Court in W.P.M.P.No.20546 of 2005, status-quo as on today, shall be maintained for a period of twelve weeks from today. Meanwhile, the petitioners shall obtain necessary orders from the appropriate Court where the suit is pending.

With the above directions, the writ petition is disposed of. No costs.

Consequently, miscellaneous petitions, if any pending, shall stand closed.
