HON'BLE SRI JUSTICE S. RAVI KUMAR SECOND APPEAL No.631 of 2014 JUDGMENT:

Advocate for appellant submitted that appellant herein deposited Rs.41,110/- (Rupees forty one thousand one hundred and ten only) to the credit of suit and Xerox copy of challan is available with the appellant, according to which, the amount of Rs.41,110/- is paid in the State Bank of Hyderabad, Gunfoundry Treasury Branch vide Challan No.129163 dated 09.07.2010, but the same is not adjusted according to his instructions.

2. Considering the submission of advocate for appellant by giving liberty to appellant to approach the Court below by way of filing appropriate petition in the pending E.P. and on filing such application, the Court below shall pass appropriate orders considering the challan produced by appellant herein.

3. With this observation, this Second Appeal is disposed of. No costs. Miscellaneous petitions, if any pending, in this Appeal shall stand closed.
