HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 29535 of 2017 ORDER:

The inaction of respondent Nos.2 and 3, in investigating into the petitioner's complaints dated 06.07.2017 and 11.07.2017 as against respondent Nos.4 to 7, is questioned in this Writ Petition as being illegal and arbitrary.

Learned Government Pleader for Home (TS), on instructions, would submit that, based on the complaint of the petitioner dated 04.07.2017, entry was made in general diary on 04.07.2017, and preliminary enquiry was conducted; after conducting preliminary enquiry, petition was filed before the II Metropolitan Magistrate, Siddipet, on 04.07.2017 seeking permission for registration of case under Section 155(2) Cr.P.C, and orders are awaited; and the contents of complaint dated 06.07.2017 addressed to the Commissioner of Police, Siddipet, are similar to the complaint dated 04.07.2017.

In the light of the fact that investigation had already been completed and preliminary report had been filed before the II Metropolitan Magistrate, Siddipet, on 04.07.2017, nothing survives for adjudication.

The Writ Petition is, accordingly, closed. However, petitioner is at liberty to approach the Court to pass appropriate orders. Miscellaneous Petition pending, if any, shall also stand dismissed.
