HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37755 OF 2016 ORDER:
The present writ petition is filed by the petitioner seeking to call for the records relating to FIR No.155 of 2016 on the file of Chinthakani Police Station, Khammam District, registered fort the offences under Sections 420 and 120-B IPC and 19(a) and 21 of the Seeds Act, and consequently, set aside the same.
Heard and perused the material available on record. The case of the petitioners is that on the complaint made by the 3rd respondent, alleging that he purchased Green Era Company mirchi seeds from Ramachandra Trading Company, through A1, believing the words of A1 that the said seeds give good results in mirchi crop, but it resulted nil crop, the above crime is registered. The grievance of the petitioners is that initially their names were not found in the FIR, but subsequently, their names are shown A7 & A8 since their husbands are doing the said business and that they are no way concerned with the said business and that the police are trying to arrest them. The learned Assistant Government Pleader submitted that on the basis of the complaint, a case was registered against the petitioners and others, and the respondents are investigating into the matter in accordance with law.
Considering the facts and circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, the 2nd respondent is directed to complete the investigation in the above crime, and file a final report, in accordance with law in either way,
without arresting the petitioners. The petitioners are also directed to appear before the investigating officer concerned as and when required and cooperate with the investigation.
With the above directions, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
