HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 30604 of 2011 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue appearing for the respondents. With the consent of the parties, the writ petition is disposed of at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in trying to evict the petitioners from the land admeasuring Acs.4.00 in Survey No.131 situated at Bahadurpally Village, Quthbullapur Mandal, Ranga Reddy District, without following the due process of law. The petitioners claim to have purchased the land mentioned above from the original assignees. According to them, they being landless poor belonging to Scheduled Caste Community are also entitled for assignment. Proceedings have been initiated against them for contravention of the provisions of the A.P. Assigned Land (POT) Act, 1977. The primary Authority ordered for cancellation of assignment of the land. Assailing the order passed by the Primary Authority, the petitioners filed an appeal before the Revenue Divisional Officer, East Division, R.R. District (2nd respondent herein) on 19.10.2005 , which is stated to be still pending consideration.

Apprehending dispossession pending the appeal, they approached this Court invoking jurisdiction under Article 226 of the Constitution of India.

It appears that earlier the petitioners filed W.P.No.10287 of 2010 before this Court. The relief sought in the said writ petition and in the present writ petition are same. By an order dated 31.08.2010, this Court disposed of the said writ petition directing the Revenue Divisional Officer, East Division, R.R. District (2nd respondent herein) to consider the appeal filed by the petitioners and pass appropriate orders within four weeks. The grievance of the petitioners is that till date, no orders are passed on the appeal, in spite of the orders of this Court. Having regard to the order dated 31.08.2010 passed by this Court in W.P.No.10287 of 2010 and without going into the merits of the case, the Writ Petition is disposed of, directing the 2nd respondent to pass orders on the appeal filed by the petitioners, in accordance with law, if the same is still pending consideration, within a period of four (4) weeks from the date of receipt of a copy of the order. There shall be no order as to costs.

Consequently, miscellaneous petitions if any pending in the writ petition shall stand dismissed.
