WRIT PETITION No. 8948 of 2004 ORDER:

This Writ Petition was filed in the Year 2004 against the combined State of Andhra Pradesh. However, in the light of the bifurcation of the State in June, 2014, the State of Telangana is the proper and necessary party to this Writ Petition. By virtue of the deeming provision contained in Section 104 of the A.P Reorganization Act, 2014, this Court directs substitution of the State of Telangana in the place of Government of Andhra Pradesh in the description of the first respondent. Office is directed to cause necessary amendment in the cause title before issuing a copy of this order. The issue raised in the Writ Petition is as to consideration of the petitioners' claims for granting pattas in respect of the lands occupied by them at Chennapur, Jawahar Nagar, Devendhar Nagar and Shamirpet in Ranga Reddy District.

Taking note of the fact that the houses of petitioners 6 and 7 had already been demolished, this Court directed status quo existing as on 11.05.2004 to be maintained as regards the structures belonging to petitioners 1 to 5, by an order of the same date. It is now represented by the learned counsel for the parties that the State of Telangana has come out with a policy for regularizing encroachments by citizens falling below the poverty line and necessary orders have also been issued to that effect. In that view of the matter, the Writ Petition is disposed of leaving it open to the petitioners to apply to the authorities concerned for regularization of their alleged possession over the subject encroached

lands in terms of the Government Policy. In the event the petitioners fulfill the requirements for grant of such benefit, the respondents shall take necessary suitable action expeditiously. Pending Miscellaneous Petitions, if any, shall stand closed. No costs.
