HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE SRI JUSTICE M. GANGA RAO WRIT APPEAL No.1093 OF 2005 AND WRIT PETITION No.21689 OF 2000 COMMON JUDGMENT: (per Hon'ble the Acting Chief Justice Ramesh Ranganathan) This appeal, under Clause 15 of the Letters Patent, is preferred against the order passed by the Learned Single Judge in W.P. No.21689 of 2000 dated 19.04.2005. The appellants herein are respondents 12 to 16 and 18 to 20 in the Writ Petition. The first respondent herein filed the Writ Petition seeking a mandamus to declare the proceedings issued by the fourth respondent dated 30.01.1995 as a nullity. By the order under appeal, the Learned Single Judge declared the order of the Collector a nullity. Aggrieved thereby, the present appeal. Sri P.V.

Vidyasagar, Learned Counsel appearing on behalf of the first respondent-writ petitioner, would seek permission to withdraw the Writ Petition unconditionally, contending that the matter is settled out of Court. He submitted that the petitioner was present in Court. He identified the person standing near him as the petitioner. The person, identified as the petitioner by Sri P.V. Vidyasagar, Learned Counsel, stated that he wished to withdraw the Writ Petition unconditionally. In the light of the aforesaid submissions of both Sri P.V. Vidyasagar, Learned Counsel for the petitioner, and the respondent-writ petitioner himself, the order under appeal is set aside, the Writ Petition is restored to file and is dismissed as withdrawn. The Writ Appeal is disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed.

No costs.
