THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25353 of 2017 ORDER:
The case of the first petitioner is that it is a dealer in purchase and sale of paddy, rice and broken rice. Petitioner Nos.2 to 4 are the owners of the vehicles. When the first petitioner was transporting rice on 30.06.2017, the Civil Supplies officials seized the stock of 178.50 quintals of A grade rice along with the vehicles. Challenging the seizure, the present Writ Petition is filed.
Learned Counsel for the petitioners submits that there is no limit for storage of paddy and rice as per the instructions of the Commissioner of Civil Supplies, Telangana, dated 11.02.2015, and in view of the same, the seizure is bad in law. But, this Court is not in a position to examine the said decision at this stage.
In the circumstances, since no useful purpose would be served by retaining the seized stock and the vehicles, the same shall be released to the petitioners on furnishing the bank guarantee to the satisfaction of the second respondent of the value of the seized stock and the vehicles. Petitioner Nos.2 to 4 shall produce the vehicles as and when demanded by the second respondent and shall not alienate the same without obtaining the consent of the second respondent. The second respondent shall complete the 6A proceedings, if any, as
expeditiously as possible, but not later than three months from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 31.07.2017 vs
