THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43520 OF 2016 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of respondent No.3 in not disposing of the appeal, dated 8.8.2016, filed by the petitioner against the order, dated 5.7.2016, of respondent No.2 as illegal and arbitrary and consequently, direct respondent No.3 to dispose of the said appeal.

Heard and perused the material available on record. 3.

The main grievance of the petitioner is that respondent No.3 is not disposing of the appeal, dated 8.8.2016, filed by the petitioner challenging the order, dated 5.7.2016, of respondent No.2.

The petitioner could not substantiate the pendency of the said appeal by way of producing any receipt or acknowledgment from respondent No.3, but learned counsel for the petitioner submitted that a direction can be given to respondent No.3 to dispose of the appeal, if the same is pending, as alleged by the petitioner. Considering all the facts and circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:

Respondent No.3 is directed to dispose of the appeal, if any, filed by the petitioner challenging the order, dated 5.7.2016, of respondent No.2 within a

period of two (2) months from the date of receipt of a copy of this order. There shall be no order as to costs. 5.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
