HON'BLE SRI JUSTICE T. AMARNATH GOUD M.A.C.M.A.No.19 of 2012 JUDGMENT:
When the matter came up for hearing, it is represented by the learned Government Pleader for Arbitration appearing for the appellants-Government that though the present appeal is preferred aggrieved by the judgment and decree dt.29.10.2009 in O.P.No.1126 of 2006 passed by the Motor Accident Claims Tribunal-cum-XXII Additional Chief Judge, City Criminal Court at Hyderabad (for brevity "the Tribunal"), wherein a compensation of Rs.2,91,500/- with interest @ 7% per annum was awarded in favour of the respondent No.1petitioner, after filing of the appeal, the appellantsGovernment has deposited by way of cheques (i) a sum of Rs.25,000/- on 27.08.2010; (ii) a sum of Rs.1,85,850/- on 18.05.2012; and (iii) a sum of Rs.1,85,850/- on 16.04.2013, total put together a sum of Rs.
3,96,700/- (Rupees three lakhs ninety six thousand seven hundred only) has been deposited before the Tribunal and a balance amount of Rs.35,738/- is payable by the appellants - Government to respondent No.1 - petitioner. To that effect, the learned Government Pleader for Arbitration has furnished a Calculation Statement and the same is made part of the record.
TA, J MACMA.No.19 of 2012 In view of the said submission, this Civil Miscellaneous Appeal is disposed of directing the appellants-Government to deposit the balance amount of Rs.35,738/- (Rupees thirty five thousand seven hundred and thirty eight only) with interest @ 7% per annum within a period of four weeks from the date of receipt of a copy of this order. On such deposit, respondent No.1 - petitioner is entitled to withdraw the same unconditionally. No order as to costs.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
