THE HON'BLE DT. JUSTICE CHILLAKUR SUMALATHA CRIMINAL PETITION No.9254 of 2022 ORDER:

Heard Sri Sanieev, learned counsel for the petitioner as well as the learned Additional Public Prosecutor who is representing respondent No. 1 2.

Seeking the Court to quash the proceedings that are pending against the petitioner, who is arrayed as accused in Crime No.1O9 of 2022 of Julapalli Police Station, Peddapalli District, the prest--nt Criminal Petition is filed. 3.

Learned counsel for the petitioner submits that the petitioner and respondent No.2 belongs to different political parties and only due to political rivalry, respondent No.2 gave a false complaint to oolice basing on which a false case is foisted. By stating so, learned counsel seeks to quash the proceedings.

On the other hand, the submission of leamed Additional Public Prosecutor is that seven witnesses were examined till now and all those witnesses supported the version of respondent No.2i de facto complainant. Leamed Additional Public Prosecutor also submits that the petitioner is involved in two other criminal cases.

The contents of the complaint in nutshell are that on 24.08.2022, the petitioner ca-lled respondent No.2 over phone and made indecent statements with regard to the saree she wore and by stating that she appears sexy. He also commented in respect of her body parts. She informed the matter to her husband. The matter was informed to the wife of the petitioner/ accused also. The petitioner went to the house of respondent No.2, took the phone of respondent No.2 and deleted the recorded conversation.

The allegations projected in the complaint are admittedly grave in nature. Though the learned counsel for the petitioner stated that due to political rivalry, such allegations are made, there is no basis or material before this court to accede to the said submission and to quash the proceedings.

This Court does not find any other grounds, more so justifiable grounds to exercise the power gra-r-rted under Section 482 Cr.P.C and to quash the proceedings. 8.

Resultantly, the crimina-l petition is dismissed.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
