O R D E R
The petitioner alleged, by way of this writ petition, that the police authorities
were harassing her and her children though no crime had been registered against them.
The Inspector of Police, Asif Nagar police station, Hyderabad, filed a counteraffidavit denying the petitioner's allegations. One Kanthati Pothuraju was stated to have lodged a complaint on the basis of which Crime No.238 of 2011 was registered under Section 363 IPC on the file of Asif Nagar police station, Hyderabad, wherein the petitioner's son was shown as an accused. He stated that in the course of investigation into this crime, the petitioner was asked the whereabouts of her son who was the accused therein.
No reply affidavit was filed in response to the above counter-affidavit. In the light of the aforestated facts, the police authorities would be at liberty to investigate the crime in question and in that process, summon and examine the persons involved or connected therewith. The petitioner therefore cannot object to such steps being taken by the police authorities. However, the police authorities would be bound to follow the due procedure laid down by law in the event they need to summon and examine the petitioner or her family members. Reserving liberty to the police authorities to do so, the writ petition is closed. Pending miscellaneous petitions shall also stand closed.
