HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.23178 of 2016 ORDER:

The action of respondent Nos.1 and 2, in interfering with the petitioner's house properties bearing Nos.1500/1A and 1500/1B and agricultural lands in Sy.Nos.674/1, 674/2 and 676/1 of Vontimitta Gram Panchayat, Kadapa District, is questioned in this Writ Petition as being illegal and arbitrary. The petitioner states that his father and respondent No.3 are brothers and the ancestral properties got divided equally between them and the subject properties fell to the share of his father and he succeeded to the said properties. Suppressing all the facts, respondent No.3 filed a civil suit in O.S.No.115 of 2014 on the file of Principal District Judge, Kadapa, and obtained ad-interim order directing not to alienate the suit properties in favour of third parties. Petitioner states that he is making construction and, respondent Nos.

1 and 2, at the instance of respondent No.3, are interfering with his construction activities. Hence the Writ Petition. Heard the learned Government Pleader for Home. In the circumstances, Writ Petition is disposed of directing respondent Nos.1 and 2 not to interfere with the civil disputes between the petitioner and respondent No.3 (unofficial respondent) without following due process of law.
