HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39714 of 2016 ORDER:

The present writ petition is filed by the petitioner seeking to declare the action of the 3rd respondent in insisting the petitioner to pay huge amounts to the 4th respondent inspite of the petitioner paying maintenance to the 4th respondent, and threatening him to implicate in other cases, as illegal and arbitrary, and consequently, direct the 3rd respondent not to interfere with the personal liberty of the petitioner.

Heard and perused the material available on record. The case of the petitioner is that there are matrimonial disputes between himself and the 4th respondent and in that regard CC No.4 of 2010 is pending on the file of I-Additional Chief Metropolitan Magistrate, Visakhpantam, and he is also paying the maintenance to the 4th respondent as directed by the Court in DVC. The grievance of the petitioner is that now the 3rd respondent, at the instance of the 4th respondent, is insisting and pressurizing the petitioner to pay huge amount to the 4th respondent and threatening him to implicate in other cases and interfering with his personal life, without there being any case registered against him.

Considering the facts and circumstances of the case and also the grievance of the petitioner, the writ petition is disposed of with the following directions:

The 3rd respondent is directed not to harass the petitioner and not to interfere with the personal life of the petitioner, without there being

any case against the petitioner, and in case, any crime is registered against the petitioner, the 3rd respondent is directed to complete the investigation of the same, and file a final report, in accordance with law in either way, without arresting the petitioner. With the above directions, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
