M/S. Spill The Beans Restaurant v. The State Of Telangana

THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.20877 of 2017 ORDER:

The present writ petition is filed seeking a direction to the respondent authorities to permit the petitioner to continue his business of serving flavoured hookahs in his coffee shop by name " M/ s.Spill The Beans Restaurant" without any hindrance or restrictions, except under law.

At the time when the matter is taken up for hearing, it is brought to the notice of this Court that the issue involved in this writ petition has already been adjudicated by this Court in a batch of writ petitions viz., W.P.No.3202 of 2015 and batch, vide common order dated 27.01.2017, and this matter is squarely covered by the said common order. The same is not disputed by the counsel appearing for respondents.

It is to be noted that this Court in W.P.No.3202 of 2015 and batch, while dismissing the writ petitions, passed the following order: " ....In view of the foregoing discussion, this Court is of the view that the action of the respondents-police is in accordance with law and any interference by this Court with the powers of the police in this regard by exercising the powers under Section 226 of Constitution of India, is not warranted.

Further, the Director General of Police, Telangana State, is directed to take appropriate action against the officers for their inaction in respect of the restaurants being used as hookah centres and also to take action against the high-handed acts of the officers, who interfered with the restaurants, which are being run without there being any violations.

CPK, J W.P.No.20877 of 2017 Accordingly, the Writ Petitioners are dismissed. No costs." In view of the judgment referred to above, this writ petition is dismissed with the directions referred to above in the common order dated 27.01.2017 in W.P.No.3202 of 2015 and batch. No costs. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed.
