THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.13120 OF 2015 ORDER:

1 This petition is filed under Section 482 Cr.P.C seeking to quash the proceedings against the petitioners/A.2 and A.3 in C.C.No.444 of 2015 on the file of the Court of the First Additional Judicial Magistrate of I Class, Kadapa.

2 When the matter is taken up for hearing, the learned counsel for the petitioners has sought permission of the Court to permit the petitioners to withdraw the petition. He further requested the Court to dispense with the presence of the petitioners before the trial Court on each and every date of adjournment.

3 There is no dispute with regard to the identity of the petitioners who are A.2 and A.3 in C.C.No.444 of 2015 before the Court below. Even if the presence of the petitioners is dispensed with, no prejudice will be caused to the 2nd respondent.

Accordingly, this criminal petition is dismissed as withdrawn by dispensing with the presence of the petitioners who are A.2 and A.3 in C.C.No.444 of 2015 on the file of the Court of the First Additional Judicial Magistrate of I Class, Kadapa. However, the petitioners shall appear before the trial Court as and when their presence is so required. As a sequel, miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed.
