HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.4533 of 2006 ORDER:

This Writ Petition is filed seeking the following relief: "....issue an order or direction declaring the action of the 1st respondent/MRO in issuing Pattadar pass book and title deed favour of respondent No.3 for Sy.No.1000/A Ac.4.01 cents,1000/B Ac.0.78 cents, 1000/C Ac.084 cents, 1000/D Ac.162 cents, 1000/E Ac.089 cents, 1003/A Ac.1.72 cents, 1008/B Ac.1.14 cents, 1003/C Ac.4.72 cents, 1003/D Ac.045 cents of Chinnatumbalam Village, Peddakadaburu Mandalam, Kurnool District, by ignoring the endorsement of respondent No.2, dated 15.9.2005, as illegal, arbitrary and unconstitutional and consequently, to set-aside the same and pass such other or further orders as this Honourable court may deem fit and proper in the circumstances of the case and pass such other."

It is represented by Mr. S.S.Bhatt, learned counsel for the petitioner, that the sole petitioner-T.G.Mallikarjuna Setty died long back and presently, there is no one in contact with him as the son of the petitioner is also seriously unwell due to chronic disease.

In view of the aforesaid facts, the Writ Petition is closed giving liberty to the interested parties to question the

proceedings as and when the cause of action arises. There shall be no order as to costs.

As a sequel, the Miscellaneous Petitions, if any, pending shall stand dismissed.
