HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI W.P. No. 10898 of 2015 O R D E R:- This writ petition is filed for the following substantive relief:

" ....to issue a Writ of Mandamus declaring the action of the 2nd respondent in not considering the application of the petitioner dated 20.04.2012 for grant of quarry lease for colour granite in an extent of 8.000 hectares in Sy.No.3 of Chintamani Village, Tekkali Mandal, Srikakulam District, in spite of specific joint inspection reports of the Tahsildar that the area applied is not a Reserve Forest, as arbitrary and illegal, and consequently direct the DMG to consider the petitioner's application dated 20.04.2012 and grant quarry lease."

When the matter came up for admission on 17.04.2015, the learned Government Pleader for Forests, on instructions, submitted that the District Level Screening Committee has to consider the matter for grant of NOC in terms of the orders issued by the Government in G.O.Ms.No.2, dated 02.01.2013; and based on the said submission, this Court passed the following order:

" Since the said Committee is headed by the District Collector, there shall be a direction to the District Collector-respondent No.2, to convene District Level Screening Committee, examine the application of the petitioner, and take appropriate decision in the matter within two months."

Inasmuch as there is already a specific direction to the District Collector to convene District Level Screening

KVL,J WP_10898_2015 Committee, examine the application of the petitioner and take appropriate decision in the matter, no further orders are required to be passed in this writ petition.

The learned counsel for the petitioner seeks liberty to file fresh writ petition if need be.

Hence, the writ petition is closed as no further orders are necessary, however, liberty is granted as prayed for. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
