THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.8315 OF 2017 ORDER:

This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner-A.2 seeking to quash the proceedings in Crime No.86 of 2017 of Ghanpur Mulug Police Station, Jayashankar (Bhupalpally) District, registered for the offences under Section 323 I.P.C. r/w Section 34 I.P.C. and Section 3(1)(r)(s) of the S.Cs. and S.Ts. (POA) Act, 2015.

It is submitted on behalf of the petitioner that ten material witnesses are examined, most part of the investigation is completed and by virtue of the stay granted by this Court on 19.09.2017 in this case, the investigation is not proceeded with. The material on record reveals that there are no justifiable grounds to quash the proceedings. 3.

Under these circumstances, the investigating officer is directed to complete the investigation in this case without arresting the petitioner-A.2 and file final report.
