HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.31383 OF 2015 ORDER:

The grievance of the petitioner is that the 2nd respondent registered a crime against him in U.D.F.O.No.7/2015-16, for the offence under Section 20 (1) (c) (ii) (iii) of the A.P. Forest Act alleging that he trespassed into the wild life protection area to cut bamboo and to transport by the vehicle belonging to the petitioner. The petitioner filed the present Writ Petition challenging the action of the second respondent in not compounding the crime in U.D.F.O.No.7/2015-16 though it is a compoundable offence.

2. Learned counsel for the petitioner submits that the offence is compoundable and though the second respondent compounded similar offences against several other persons, for the reasons best known to him, had not compounded the crime in U.D. F.O.No.7/2015-16.

3. In the circumstances, the Writ Petition is disposed of directing the second respondent to consider the case of the petitioner for compounding the crime in U.D.F.O.No.7/2015-16, if it is otherwise compoundable under the provisions of the relevant Acts.
