THE HON'BLE SRI JUSTICE K. LAKSHMAN CRIMINAL APPEAL No.965 OF 2007 ORAL ORDER:

Mr. N. Satchidanand, learned counsel for the appellant, would submit that the appellant - Tangirala Venkata Swamy, who is arraigned as Accused Officer No.7 in C.C. No.2 of 2003 on the file of the Special Judge under the Prevention of Corruption Act for speedy trial of cases of embezzlement of scholarship amounts in Social Welfare Department etc., City Criminal Courts, Hyderabad, is no more. In support of the same, he filed a memo on 05.12.2019 along with photostat copy of Death Certificate, dated 26.04.2019, issued by the Registrar of Births and Deaths, Circle No.3, GHMC, Hyderabad.

2. The said Death Certificate discloses that the appellant - Accused Officer No.7 died on 24.03.2019.

3. The learned Assistant Public Prosecutor appearing for the State would confirm the same on verification of the copy of death certificate.

4. In view of the above, the present Criminal Appeal stands abated and accordingly the same is dismissed as abated. As a sequel, miscellaneous applications, if any, pending in the appeal shall stand closed.
