THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.8347 of 2018 ORDER:

This Criminal Petition is filed under Section 482 of Criminal Procedure Code (for short "Cr.P.C.") to issue a direction to learned IV Additional Judicial Magistrate of First Class, Kakinada, to dispose of C.C.No.315 of 2010, pending on its file. 2.

Learned counsel for the petitioner submits that earlier the petitioner filed Crl.P.No.5469 of 2015 and this Court disposed of the same by order, dated 29.06.2015, directing the Court below to dispose of aforesaid Calendar Case within three months by giving priority, as the Calendar Case is of the year 2010. In spite of the said direction, the learned Magistrate has not disposed of the case. 3.

Though three years time has elapsed, the learned Magistrate did not adhere to the direction issued by this Court and failed to dispose of the petition, which lead to filing of contempt case. In stead of filing the contempt case, the petitioner again approached this Court seeking a fresh direction.

In view of the above and taking into consideration the facts and circumstances of the case, the Criminal Petition is disposed of directing the learned IV Additional Judicial Magistrate of First Class, Kakinada, to dispose of aforesaid Calendar Case, keeping in mind the order passed by this Court on 29.06.2015 in Crl.P.No.5469 of 2015, as expeditiously as possible. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
