THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION NO.21096 OF 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"declaring the final order No.; ST/114/(3)/2011- RM (NLR) dated 15.04.2013 passed by 2nd respondent herein imposing major punishment of deferment of annual increments for a period of two years with cumulative effect without following the CC & A regulations, and conducting the departmental enquiry as illegal, arbitrary and violation of principles of natural justice and contrary to judgments of this Hon'ble Court and Law and setaside the same and further direct the respondents herein to restore the deferred increments with all consequential benefits including re-fixation of pay and payment of arrears and pass such other order or orders may deem fit and proper in the circumstances of the case".

It is brought to the notice of this Court that in identical set of circumstances this court in W.P.No.1224 of 2011 and batch, passed an order on 19.11.2014 and the copy of the same is also placed on record. In view of the above and for the reasons recorded in the above mentioned order, the writ petition is disposed of with the following directions:

"The impugned orders passed by the 2nd respondent shall be treated as one for stoppage of annual increments without cumulative effect. It is also made clear that the petitioner herein is also not entitled for any monetary benefits." Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. ____________________ A.V. SESHA SAI, J.
