THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12560 of 2025 This Criminal Petition is filed seeking the Court to relax the condition imposed on the petitioner while granting bail in Crl.M.P.No.519/2025 in Crime No. 372/2025 of K.U.C. Police Station, on the file of the learned Special Sessions Judge for NDPS Cases-cum-I Additional District & Sessions Judge, Warangal, Warangal District, wherein the petitioner was directed to furnish one surety who must be a local resident of the place of the petitioner/accused No.1, and permit the petitioner to furnish two sureties from the State of Telangana.

Heard Sri Dr. Challa Srinivas Reddy, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent-State. 3.
Learned counsel for petitioner submitted that the petitioner/accused No.1 was granted bail by the trial
Court on the petitioner/accused No.1 executing a personal bond for Rs.10,000/- with two sureties for a like sum each and one surety must be local resident place of the petitioner/accused No.1 to the satisfaction of the learned III-Additional Judicial Magistrate of First Class, Hanumakonda. It is further submitted that the petitioner herein is a local of Uttar Pradesh and he is residing in Hanumakonda and it is difficult for the petitioner to comply with the said condition as he left his native place i.e. Uttar Pradesh about 20 years ago and therefore, he prayed the Court to relax the said condition and permit the petitioner to furnish one surety of local resident from Hanumakonda.

Having regard to the submissions made by the learned counsel for the petitioner, as the petitioner is unable to comply the said condition as he left his native place i.e. Uttar Pradesh about 20 years ago and as he is residing in Hanumakonda, this Court is inclined to permit the petitioner to furnish the same i.e. one surety of local resident from Hanumakonda.

In view of the above, this Criminal Petition is allowed.
Miscellaneous applications, if any pending, shall also stand closed.
