HON'BLE SRI JUSTICE G. CHANDRAIAH AND HON'BLE SRI JUSTICE U. DURGA PRASAD RAO WRIT PETITION No. 16420 OF 2015 ORDER: (Per the Hon'ble Sri Justice G. Chandraiah) This writ petition is filed by the petitioner questioning the order dated 21.04.2015 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.2045 of 2015, whereby the Tribunal while admitting the O.A ordered notice to the respondents returnable in six weeks.

The petitioner herein filed the O.A seeking direction to respondents 1 and 2 to consider his case for promotion as Town Planning Officer on par with the third respondent with effect from 04.03.2013 with all consequential benefits. The petitioner also sought for interim relief directing respondents 1 and 2 to consider his case for promotion on par with the third respondent in terms of order issued in G.O.Ms.No.424, General Administration (Ser.C) Department, dated 25.05.1976, and promote him as such. The matter appears to have come up for admission before the Tribunal on 21.04.2015 and on that date, the Tribunal admitted the O.A and ordered notice to the respondents returnable in six weeks. Hence, this writ petition. Admittedly, the petitioner filed the O.

A seeking direction to respondents 1 and 2 to consider his case for promotion and the interim relief sought for by him is also to the same effect. Therefore, the Tribunal has not granted the interim relief and while admitting the O.A, ordered notice to the respondents returnable in six weeks. In view of the same, we see no reason to interfere with the impugned order. The Writ Petition is accordingly dismissed. However, this order will not preclude either the petitioner from claiming appropriate relief before the Tribunal or the Tribunal from passing appropriate orders. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall also stand dismissed.
