THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12552 of 2025 ORDER:

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.6 in Crime No.117 of 2025 before the Velgatur Police Station, Jagtial District.

The brief facts of the case are that the complainant lodged a report stating that he was cheated by certain persons who promised to convert black-coloured Rs.500 currency notes into original notes through a chemical process. Believing their words, the complainant paid Rs.7,00,000/- to them. Later, the accused persons took him to another place, pretended to involve police, and escaped with the amount. 3.

Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner was falsely implicated in the case solely on the basis of the confessional statements of co-accused, which have no evidentiary value in law and that no specific overt act was attributed to the petitioner, and the ingredients of Section 111 of BNS were not attracted. He further submitted that the petitioner had no criminal antecedents and the material part of the investigation was completed. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the bail stating that the allegations leveled against the petitioner are serious in nature. Further, the investigation was not yet completed. At this stage, granting of pre-arrest bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the name of the petitioner was not mentioned in the report lodged by the complainant. However, in the remand report, it is stated that accused Nos.1 to 8 went to the complainant's house and cheated him under the pretext of converting black-coloured currency into original Rs.500 notes, but no specific role was attributed to the petitioner. As seen from the remand case diary, there is a criminal history pertaining to accused Nos.1, 2, 4, and 5, whereas no other criminal case is pending against the petitioner so as to attract Section 111 of the BNS. Further, as seen from the record, accused Nos.1, 2, 4, 5, and 8 were arrested and released on bail. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions: i.

The petitioner shall surrender before the Station House Officer, Velgatur Police Station, Jagtial District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on

executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required 7.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
