This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.1 in Crime No.332 of 2022 pending on the file of Station House Officer, Abdullapurmet Police Station, Rachakonda registered for the offence punishable under Section 8(c) read with Section 20(b)(ii)(C) of NDPS Act - 1985.

Heard learned counsel for the petitioner/Accused No.1 and the learned Additional Public Prosecutor for the respondent-State. Perused the record.

The case against the petitioner is that he was found in possession of 1 kg 10 grams of Hashish Oil along with Accused No.2. 4.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated and he has nothing to do with the alleged seizure. He also submits that the provisions of NDPS Act were not followed while conducting seizure by the police.

On the other hand learned Additional Public Prosecutor submits that the investigation is in progress. 6.

In the said circumstances, keeping in view the quantity of the contraband seized, this Court is not inclined to grant the relief of regular bail at this juncture.

Accordingly, the Criminal Petition is dismissed. However, the petitioner is at liberty to renew his bail application under changed circumstances.
