HON'BLE SRI JUSTICE S.V. BHATT C.R.P.No.858 OF 2013 ORDER:

The third petitioner to execution proceedings vide E.P.No.115 of 2007 aggrieved by the order of the executing Court in E.A.No.167 of 2012, which was filed to set aside the ex parte order dated 03.09.2012, has filed the instant revision.

I have perused the affidavit filed by the 2nd respondent herein and also the reasons assigned by the executing Court. I am convinced that no ground is made out warranting interference under Section 115 CPC.

Revision fails and is, accordingly, dismissed. The executing Court considers and passes orders in E.P.No.115 of 2007 within two months from the date of receipt of a copy of this order. All objections available in law and fact are left open for consideration by the executing Court. There shall be no order as to costs.
