THE HON'BLE Dr. JUSTICE G. RADHA RANI CRIMINAL PETITION No.13076 OF 2024 ORDER:

This criminal petition is filed by the petitioner - Accused No.1 under Sections 480 and 483 of the BNSS to enlarge the petitioner - Accused No.1 on bail in Crime/COR No.207 of 2024 on the file of the Station House Officer, Prohibition and Excise Police Station, Patancheru, registered for the offences under Section 8(c) read with Section 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substance Act, 1985 (for short 'the NDPS Act'). 2.

Heard Sri Palle Sriharinath, learned counsel for the petitioner-Accused No.1 and learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the petitioner was arrested on 28.09.2024 on the allegation that 10.198 kgs of dry ganja was seized from his possession. The petitioner was a student. There were no criminal antecedents against him and prayed to enlarge the petitioner on bail.

The learned Additional Public Prosecutor submitted that the investigation is not yet completed and other accused persons were absconding.

Perused the record.

Considering that the petitioner was in custody since 28.09.2024 and the petitioner was a student and only an intermediary quantity of contraband was seized from his possession and no criminal antecedents were reported against him, it is considered a fit case to enlarge the petitioner on bail. 7.

In the result, the Criminal Petition is allowed directing the jail authorities to release the petitioner on bail subject to his executing a personal bond for Rs.20,000/- with two (02) sureties for the like-sum each to the satisfaction of the I Additional Sessions Judge, Sangareddy, Sangareddy District. Further, the petitioner shall abide by the conditions laid down under Section 480(3) of the BNSS.

Miscellaneous applications, if any, pending, shall stand closed.
