The present revision petitions are filed by the petitioner/judgment debtor against the order passed under Order 21 Rule 37 & 38 C.P.C., by the Senior Civil Judge, Repalle, dt.31.08.2010 in E.P.Nos.15, 14, 11 & 13 of 2010 in O.S.Nos.37, 36, 35 & 26 of 2009 respectively, ordering arrest of the petitioner, as he has failed to pay the decretal amount. On 31.10.2010 this Court at the time of admission, granted interim stay in C.R.P.MP.Nos.8173, 8171, 8213 & 1058 of 2011 respectively, on condition of the petitioner depositing half of the decretal amount and permitted the respondent/decree holder to withdraw the same.
When the matter is listed, the learned counsel for the petitioner stated that 50% of the amount is already paid and he seeks four months time to pay the balance amount. The learned counsel for the respondent opposed for grant of four months time and stated that reasonable time may be granted to the petitioner.
Since 50% of the amount is already paid and in view of
facts and circumstances, the petitioner/defendant is granted three months time for payment of the balance amount, as per the judgment and decree passed by the court below. On such deposit, the respondent is permitted to withdraw the same without furnishing any security. In default, it is open for the respondents/decree holders to execute the impugned orders of arrest.
The revision petitions are accordingly disposed of. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
