HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14534 OF 2017 ORDER:

This writ petition is filed challenging the notice issued by the 1st respondent in File No.B/137/2017, dated 25.03.2017 against the petitioners in pursuant to the application made by the respondent No. 3 for mutation of her name in the revenue records in respect of the land admeasuring Ac.8-00 guntas in Sy.No.364 of Poodur Village, Medchal Mandal, Ranga Reddy District.

Learned counsel for the petitioner submits that on earlier occasion when no orders are passed by the 1st respondent on the application filed by the petitioners seeking to set aside the ex-parte decree, petitioners filed W.P.No.38313 of 2015 and this Court vide order dated 25.11.2015 directed the enquiry to be deferred, for a period of four weeks. He further submits that since there was stay in the writ petition, present notice would not have been issued.

On the other hand, learned Assistant Government Pleader for Revenue submits that only notice is issued in pursuant to the Bifurcation of the Mandals.

In this case, it is to be seen that there is an interim order for deferring the enquiry for a period of four weeks and Counsel has not brought to my notice any order to the extent of setting aside the ex-parte decree.

In view of the same, it is open for the petitioners to raise all the objections raised herein in pursuant to the notice dated 25.03.2017 and the 1st respondent shall consider the same and also an opportunity of hearing shall be given to the petitioners as well as unofficial respondents before taking further action on the application of the 3rd respondent and thereafter he shall conclude the enquiry and pass orders thereon. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 21.04.2017 dv
