HON'BLE SMT JUSTICE ANIS CRIMINAL REVISION CASE No.2633 OF 2012 O R D E R:
This Criminal Revision Case under Sections 397 and 401 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C') is filed by the revision petitioner seeking to set aside the orders passed in M.C.No.14 of 2009 on the file of III Additional Judicial Magistrate of First Class, Kakinada dated 31.10.2012.
2. The learned counsel for the petitioner-respondent argued that the compromise was affected on 18.12.2004 and as per that compromise, the petitioner herein agreed to pay Rs.14.00 lakhs to the respondent towards permanent alimony, for that respondent agreed. Learned counsel also filed the common order passed by the Division Bench of this Court in C.M.A.M.P.No.57 of 2015 in/and C.M.A.No.957 of 2012, wherein the compromise was affected and marriage between the petitioner and respondent was dissolved.
3. Both the counsels reported that the compromise was affected and no objection to set aside the judgment in M.C.No.14 of 2009 dated 31.10.2012. In view of the compromise affected by both the parties, the criminal revision case is allowed setting aside the judgment in M.C.No.14 of 2009 dated 31.10.2012.
4. Miscellaneous petitions pending, if any, in this Criminal Revision Case shall stand closed.
