THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 45363 of 2016 ORDER:

Petitioners state that Crime No.50 of 2016 was registered against them by respondent No.2 under Sections 307, 354, 323, 324 and 506 read with Section 34 I.P.C. on 08.09.2016 basing on the complaint given by respondent No.3, who is none other than their sister-in-law. There were civil disputes between the petitioners and respondent No.3. The petitioners also lodged a complaint against respondent No.3 and a crime was registered and the same is pending.

It is the case of the petitioners that the police, instead of taking action against respondent No.3, are harassing them. Therefore, they approached this Court by filing the present writ petition challenging the registration of the said crime on the basis of the complaint given by respondent No.3.

Since Crime No.50 of 2016 was registered against the petitioners and it is under investigation, this Court is not inclined to interdict the same. So far as the alleged harassment of the petitioners is concerned, it is needless to observe that respondent No.2 shall follow due process of law while investigating the said crime.

With the above observations, the writ petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:18.01.2017 kdl
