THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.9287 OF 2022 O R D E R:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, seeking pre-arrest bail to the petitioners/accused Nos.2 and 3 in the event of their arrest in connection with Crime No.429 of 2022 of Hanamkonda Police Station, Warangal District, registered for the offences punishable under Sections 420 read with Section 34 of the Indian Penal Code and Section 5 of the Telangana State Protection of Depositors Financial Establishment Act, 1999. 2.
Heard learned counsel for the petitioners/accused Nos.2 and 3 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The complaint was lodged stating that Sudhathri Chit Fund Company, Hanamkonda, was being run by accused No.1, who is the Chairman and these petitioners were wife and son of accused No.1. The de facto complainant has narrated that he was a chit member in several chits and ultimately amounts were deposited with the firmSudhathri Chit Fund Company. 4.
As seen from the complaint, the transactions dealt with by accused No.1 and there are no specific events that are stated against these petitioners to suggest their involvement in day to day business of said chit funds. For the said reason and since accused No.1 was
already arrested and sent to judicial remand, this Court is inclined to grant the relief of anticipatory bail to the petitioners/accused Nos.2 and 3 subject to the following conditions:
i) The petitioners/accused Nos.2 and 3 are directed to surrender before the Station House Officer, Hanamkonda Police Station, Warangal District, within a period of 10 days from the date of this order. On such surrender, the said Station House Officer shall release the petitioners/accused Nos.2 and 3 on bail, on their executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties in a like sum each to his satisfaction. ii) On such release, the petitioners/accused Nos.2 and 3 shall report before the said Station House Officer on every Monday between 10.00 A.M. and 02.00 P.M., for a period of six weeks, thereafter as and when required.
iii) The petitioners/accused Nos.2 and 3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
