This civil miscellaneous appeal is filed by the appellantsproposed parties under Order XLIII Rule 1 of CPC assailing the order dated 08.2.2005 in I.A. No.1650 of 2004 in O.S. No.97 of 2004 on the file of the Court of Principal Senior Civil Judge, Tenali. 2.

At the time of hearing, learned counsel for the appellants submitted that the trial Court disposed of O.S.No.97 of 2004; therefore, the purpose of filing of the appeal has become infructuous. The same is recorded.

Accordingly, the civil miscellaneous appeal is dismissed as infructuous. Miscellaneous petitions if any pending in this petition shall stand closed.
