CVNR,J C.R.P.No.4566 of 2018 ORDER:

This Civil Revision Petition is filed against concurrent findings rendered against the petitioner, who is the tenant of the demised premises, and his eviction based on such findings. All the three pleas of the respondent-landlady viz., her bona fide requirement, denial of her title by the petitioner-tenant and willful default by the petitioner-tenant were upheld by both the primary and appellate fora.

Having realized that there is no scope for this Court to interfere with concurrent findings, Mr.A.Laxminarayana, learned counsel for the respondent, has fairly agreed for granting reasonable time to the petitioner for vacating the demised premises. 3.

Having regard to the above facts and circumstances of the case, the Civil Revision Petition is dismissed in the following terms. (i) The petitioner shall handover vacant possession of the petition schedule property to the respondent on or before 25.12.2018 by paying the entire arrears as on the date of such handing over;

(ii) Within ten days from today, the petitioner shall file a sworn affidavit undertaking to handover vacant possession before the Rent Controller, Visakhapatnam, within the time stipulated in clause (i) supra;

CVNR,J C.R.P.No.4566 of 2018 (iii) In default of compliance of either of the two conditions supra, the respondent is entitled to execute the decree for eviction besides initiating contempt proceedings. 4.

As a sequel to dismissal of the Civil Revision Petition, I.A.No.1 of 2018 filed by the petitioner for interim relief stands dismissed as infructuous.
