HON'BLE SRI JUSTICE T. AMARNATH GOUD CRIMINAL PETITION No.6820 of 2011 ORDER:

This criminal petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings against the petitioners in Cr.No.447 of 2011 on the file of P.S., Madhapur, registered for the offences under Sections 447 and 427 IPC.

The 1st respondent is the de-facto complainant and the petitioners herein are the accused. It is the case of the 1st respondent that petitioners 1 and 2 have trespassed and threatened him at his house.

This Court, by order dated 09.08.2011 vide Crl.M.P.No.7041 of 2011, granted interim stay. Crl.P.M.P.No.4020 of 2015 has been filed seeking to vacate the interim stay.

Without going into the merits of the case and without expressing any opinion thereon, the criminal petition is dismissed. The prosecution is directed to investigate the crime and file charge sheet in the light of Section 41-A Cr.P.C. Till investigation is completed and charge sheet is filed, the petitioners/accused shall not be arrested. The petitioners/accused shall cooperate with the investigation.

As a sequel, miscellaneous petitions if any pending stand closed.
